General Terms and Conditions of EYWINEO online store are set in accordance with the Consumer Protection Act, recommendations of the GZS (Chamber of Commerce and Industry of Slovenia) and international codes for e-commerce.
Definitions
- ‘Seller’ is EYWINEO eterična olja, Vinko Nedelko s.p., owner of the online store EYWINEO and producer of EYWINEO essential oils and hydrolats.
- ‘Consumer’ is the person who uses seller’s system, i.e. buyer in the online store.
- ‘Online store’ is an information system designed to present and sell products to the consumer.
Registration
When registering in the online store, the visitor obtains a user name that is identical to the address of his/her e-mail and a password of his/her choice. The user name and password unambiguously define and link the visitor to data that he/she provided. After the registration, the visitor becomes the consumer and acquires the right to purchase. General Terms and Conditions describe the functioning of EYWINEO online store (www.eywineo.eu), the rights of the consumer and the business relationship between the seller and the consumer.
The seller undertakes to provide the consumer with the following information:
- identity of the seller (name and registered office, register number)
- contact details enabling fast and efficient communication (e-mail)
- essential characteristics of products or services (including after-sales services and guarantees)
- availability of goods (any product or service offered on the website should be available within a reasonable time frame)
- conditions for delivery of products or services (method, place and time of delivery)
- unambiguous prices: clearly indicating whether they include taxes and delivery costs
- method of payment and delivery
- validity of the offer
- right to withdraw from the contract and the cost for returning the goods
- complaint procedure including details about the customer service or a contact person.
Purchase process
When selecting a product to buy, the consumer can add it to the shopping cart by clicking “add to cart” button. The cart symbol is located at the top right end of the screen. By clicking on it, the consumer will see the content of his/her cart with the products that he/she accumulated (picture, description, price of the product). The consumer can change the quantity of products or remove them from the cart before completing the purchase. To do this, the consumer can press “+” to increase the number of selected products, or press “-” to reduce, or press “x” to remove a product from the cart.
The consumer can continue shopping and add other products, or finish his/her purchase.
Once the consumer has selected the products that he/she wishes to purchase, the consumer clicks on “proceed to checkout”. In this step, the consumer enters his/her personal information if purchasing as a guest. Consumers who have already registered in EYWINEO system will have that data filled in automatically as they log in with their password.
The consumer can also choose to have his/her order delivered to a different address. The consumer can do that by clicking on “DELIVERY TO ANOTHER ADDRESS”, and enter the name and address details where he/she wants the order to be delivered.
In the next step, the consumer selects the payment method and checks the entered information (personal details, delivery address, selected products and quantities, payment method).
Before completing the order (BUY NOW button), the consumer confirms that he/she has read Terms and Conditions and Privacy Policy by clicking:

The purchase is completed by pressing the BUY NOW button. The online store will automatically send to the consumer an e-mail confirmation with order details (products, prices, quantities, consumer data…) to the e-mail address that the consumer provided. With this step the order is confirmed and the products will be dispatched as soon as possible. The seller will inform the consumer if the shipment will take more than 3 working days.
Placing the order obligates the consumer to pay for the ordered goods and take them over when delivered.
Order cancellation
Cancellation of the order is possible up to one hour after the order has been placed, or until 1 p.m. (valid for orders placed just before 1 p.m.). After this hour orders are dispatched to the delivery service and in most cases delivered already the following working day.
Payment
The seller will issue an invoice with cost details. The consumer may pay by a bank card, by PayPal or by a bank transfer further to a proforma invoice (valid for Slovenia and abroad). The invoice will show the break-down of costs and the notice of the right to withdraw from the contract. The consumer is responsible to verify the invoice details prior to proceeding to payment.
Payment by bank transfer in Slovenia
The consumer is to see with his/her bank about the transfer fee charge.

Proforma invoice is valid for three working days. The seller reserves the goods ordered via proforma for only three working days. If the payment is not received within three working days, the order will be canceled and reserved goods return in sale.
PayPal payment
PayPal represents a simple and above all a safe way to pay online. The seller does not see consumer’s credit card number. The consumer may pay via PayPal with various payment cards (Visa, MasterCard, American Express…). To start using PayPal, the consumer needs to create a user account which is free of charge and provides the consumer with an anonymous, secured, and quick payment option.
Payment with bank cards
The consumer adds products that he/she wishes to buy to the cart; chooses the bank card payment option; enters the bank card number and security code; confirms the payment to complete the purchase.
Delivery time
Standard delivery time for products in stock is 1 – 3 working days. In the event of a longer delivery time, the seller shall inform the consumer by e-mail or by phone.
Delivery
The seller must deliver the products or services within the promised time. At the time of delivery, the seller must present the consumer with the information about consumer’s right to withdraw from the contract. The seller must indicate the address which the consumer may access for possible complaints, guaranty claims or other after-sales services.
Ordered goods are dispatched within 1 – 3 working days of the order placement or bank payment transfer. Standard time for the reception of goods in Slovenia is the following working day. This time is rarely longer. When the order is processed and the goods sent, the consumer will be notified via e-mail which he/she specified in contact details. Deliveries are traceable; the consumer may contact the seller at info@eywineo.eu if he/she has not received the parcel or waits for a long time. The seller will check the whereabouts of the delivery.
The cost for delivering goods in Slovenia:

Prices for all products are in the Euro currency and include VAT (value added tax).
For purchases over 45 € (including VAT) delivery is free of charge. When purchasing up to 45 € (including VAT), the consumer will be charged the delivery cost which will be specified in the invoice. The payment can be made by a bank card, PayPal or a bank transfer.
Pošta Slovenije is used for the parcel delivery in Slovenia.
Delivery via Pošta Slovenije
The ordered goods will be delivered to the address that the consumer specified as delivery address. Deliveries take place mostly in the morning. If the consumer cannot take over the parcel at the time of delivery, he/she can pick it up later at the nearest branch office of Pošta Slovenije (within 15 days).
Before placing the order the consumer has been made aware that “By placing the order the consumer commits to pay for the order” By placing the order, the consumer agrees with this affirmation and receives a copy of the order to the e-mail address that he/she provided. The placement of the order thus obliges the consumer to pay for it.
Delivery to the parcel machine of Pošta Slovenije
When choosing a delivery address, prior to completing the order, the consumer can also select an alternate delivery to the parcel machine of Pošta Slovenije , to a gas station pick-up point, or to a post office by clicking on the yellow button – arrange delivery. Delivery to other EU countries
Within the EU, the seller delivers to Austria and Germany. The delivery costs equal those for deliveries of up to 2 kg of gross weight. Payment is possible by a bank transfer per proforma invoice, by PayPal or a bank card.

Right to withdraw from the contract, return/exchange of goods
Withdrawal from contract
The consumer has the right to inform the seller of his/her decision to withdraw from the contract without giving any reasons for such decision.
The consumer may inform the seller of his/her decision to withdraw from the contract by using the form available on the link CONTRACT WITHDRAWAL or by writing an unequivocal notice setting out consumer’s decision to withdraw from the contract, sent by e-mail to info@eywineo.eu
The consumer shall be deemed to have delivered the notice of withdrawal on time when it is sent within the time limit set for the ‘withdrawal from the contract’.
The only cost that the consumer bears is the direct cost of returning the goods. The goods must be returned to the seller no later than 14 days after the notice of withdrawal. The goods must be unused, undamaged and in their original packaging with original documents enclosed, or else the consumer will be liable for a reduced value of the goods due to improper handling.
In the event of withdrawal, the seller shall immediately, or not later than 14 days from the day of the reception of consumer’s notice of withdrawal from the contract, reimburse all payments received from the consumer.
The reimbursement shall be paid in full, with the deduction of delivery costs. The consumer bears the cost of returning the goods. The reimbursement may be withheld until the seller receives the returned goods.
The seller shall carry out the reimbursement using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly requested the use of other means and provided that this does not incur any cost for the seller.
The consumer may view and test the goods in the extent that is strictly necessary to establish the good state of the goods and as it is customary in shops. Any ‘testing’ which deviates from that may be regarded as the usage of goods and the consumer shall be liable for the reduced value of the goods.
If the consumer returns the goods with return costs imputed to the seller, the seller will reject the reception of the goods. The consumer shall bear the direct cost of returning the goods.
Exchange of goods
If the consumer purchased a product that he/she would like to change with another product, the consumer should fill out the form RETURN GOODS. The cost of returning the goods to the seller is to be covered by the consumer. The option to exchange goods is possible within 14 days of the delivery of the goods.
Only unused products in original sealed packaging can be exchanged. The return of goods for the exchange follows the conditions stipulated in the section ‘The Right to withdraw from the contract’.
When exchanging goods, the price paid for initially ordered goods is taken into account. For newly selected goods, prices that are stated in the online store at the time of returning the goods will be taken into account in the process of exchanging the goods.
Complaints
In cases when the consumer is delivered the goods which are not accompanied by all documents, or an error occurred in the invoice or the like, the consumer should contact the seller at info@eywineo.eu describing the defect. The seller will reply to the consumer as soon as possible with an explanation, instructions or by sending a missing product.
The consumer is advised to check the goods upon the delivery and if a defect is found with a product or a product does not comply with the description in the online store, the consumer should inform the seller at info@eywineo.eu The purchased product must be returned in undamaged packaging. The consumer bears the cost of returning the product.
Material defect
A defect shall be deemed material if:
- the product does not have the characteristics necessary for its regular use or placing in circulation;
- the product does not have the characteristics necessary for the special use for which the consumer bought it, and this was or should have been known to the seller;
- the product does not have the characteristics and features that were expressly or tacitly agreed upon or prescribed;
- the seller delivered a product that does not match the sample or model, unless the sample or model was only shown for information purposes.
The adequacy of a product for normal use shall be assessed in relation to a usual product of the
same kind and by having regard to any declarations of the seller as to the characteristics
of the product, provided by the seller through, in particular, advertising, presentation
of the product or indications on the product.
The consumer exercises his/her right resulting from a material defect on the condition that the consumer notifies the seller of the defect within two months of the delivery of the goods. The seller is not responsible for any material defects that may appear two years from the date of delivery of the goods.
The right to assert a material defect is defined in more detail by the ‘Consumer Protection Act’.
Guaranty
The consumer may exercise his/her guaranty claims whenever within the guaranty period. The consumer may claim guaranty for products for which guaranty is mandatory (the list of these products is laid down in the ‘Regulations on goods, for which conformity guarantee shall be issued’) and for those for which the guaranty is non-mandatory. In the guaranty period, the consumer may request that a defect be repaired free of charge. If the defect cannot be repaired or is not repaired within 45 days, the consumer may request a replacement with a new product free of charge.
What is guaranty enforcement process?
The consumer must within the guaranty period and under guaranty conditions submit a written claim that defects be repaired. The claim must be accompanied by the product, the guaranty certificate and a copy of the invoice. The consumer shall not bear any costs occurring with the repair or the replacement of the product. If the seller finds that the defect on the product was caused by an improper handling by the consumer, which makes the guaranty claim unjustified, the seller will return the product to the consumer with return costs imputed to the consumer.
Damaged parcels, unclaimed parcels
Treatment of parcels damaged during shipment
If the consumer notices that you the parcel delivered is damaged, that the goods are missing or that it had been opened, the consumer is asked to immediately inform the seller at info@eywineo.eu for further instructions. The seller will start the complaint procedure with Pošta Slovenije. The consumer is to leave the parcel in the same condition as delivered (without adding or removing anything), keeping the original packaging! The seller will request that the consumer provides a photo of the parcel, of (internal) packaging of damaged goods, of postal stickers and stamps, and the description of the damage.
The report will be handled by the commission at Pošta Slovenije and, on the basis of their reply or approval, the consumer will be reimbursed the cost of the goods or will receive new goods. The seller will endeavor that the claim be solved as soon as possible.
Unclaimed parcels
When the seller processes the order and dispatches it via postal service, the consumer is informed by an e-mail about the delivery in the following days. If the postal service is unable to hand the parcel in person, a delivery notification slip will be left in the consumer’s physical mailbox. The consumer is to pick up the parcel in the designated post office within 15 days. If the consumer does not pick up the parcel in due time, it is returned to the seller. If for any reason, the consumer does not receive a delivery notification from the postal service, he/she can contact the seller at info@eywineo.eu who will provide information for picking up the parcel.
Validity of the offer
Valid prices are those set at the time of order placement. All prices include value added tax (VAT).
Security
The seller shall use appropriate technological and organizational systems in order to protect the transfer and storage of personal data, orders and payments.
Communication
The seller may contact the consumer via a virtual communication channel unless the consumer explicitly objects to it.
Archiving contracts
The contract concluded between the seller and the consumer is permanently stored at EYWINEO eterična olja, Vinko Nedelko s.p., Rošpoh-del 157B, 2351 Kamnica. The consumer can obtain a copy upon request sent to info@eywineo.eu
Promotional e-mails must contain the following components:
- be clearly and unambiguously marked as promotional messages;
- sender must be clearly visible;
- various campaigns, promotions and other marketing options must be marked as such. Conditions for participation in those must also be clearly defined;
- consumer’s wish not to receive promotional messaging must be respected.
Complaints
The seller complies with the applicable Consumer Protection Act. A complaint may be submitted by an e-mail to info@eywineo.eu Within five working days, the seller shall confirm by an e-mail the reception of the complaint and inform the consumer of the estimated time for processing it. The seller is aware that the essential feature of a consumer dispute, at least as far as the court resolution is concerned, lies in its disproportionate nature between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer for not to bring a dispute before a court. The seller shall therefore do his utmost to resolve any disputes by mutual agreement.
EYWINEO online store does not recognize any mediator responsible for out-of-court litigation (IRPS) that could engage in the consumer dispute resolution via the European Online Dispute Resolution (ODR) platform.

Data operator
The operator of consumer’s personal data is EYWINEO eterična olja, Vinko Nedelko s.p., Rošpoh-del 157B, 2351 Kamnica, Slovenia.
Purpose of data processing and type of personal data
Any personal data provided by the consumer will be treated confidentially and used only for the purposes for which the consumer provided it. If there is a need to further process consumer’s data for any other purpose, the data operator will inform the consumer in advance and ask for consumer’s consent.
Visit and use of the website
Each time the consumer visits the web page www.eywineo.eu the web server automatically saves the log file (e.g. IP number — a number that identifies each computer or other device associated with the Web; browser version, visit time, and the like). This data are processed for the purposes of keeping statistics about the website visit. EYWINEO eterična olja, Vinko Nedelko s.p. processes the collected data separately and does not associate them with other data.
Retention period
The data operator assures the consumer that consumer’s data will be kept only for the period that is necessary to fulfill the purpose for which the data were collected and used, namely:
- Web server log files are retained for 3 (three) months;
- consumer’s contact details for communication purposes are processed until the transaction is completed or the communication is completed;
- if there is a different legal retention period for contractual agreements (e.g. accounting or tax data) the retention period shall be 10 (ten) years. In that period data processing is limited;
- when the data are no longer required they will be immediately, securely and permanently disposed of.
The Right of access to data
The consumer has the right to obtain information from the data operator whether his/her personal data are being processed, and if this is the case, the consumer has the right to access the following information regarding the processing of personal data:
- purpose of the processing,
- categories of personal data being processed,
- recipient or categories of recipients of the personal data, especially third (non EU) countries and international organizations,
- where possible, retention periods or the criteria used to determine them,
- the right to demand a rectification or erasure or restricted processing of personal data ,
- the right to file a complaint with a supervisory authority,
- sources of personal data when those are not provided by the consumer,
- the existence of automated decision-making, including profiling, and meaningful information on the reasons for it, as well as the significance and foreseeable consequences of such processing for the consumer.
Based on consumer’s request, the data operator will provide the consumer with a free copy of consumer’s personal data that are being processed. For additional required copies the data operator may charge to the consumer a reasonable fee, taking into account administrative costs.
The Right to rectification
The consumer has the right to require that data operator rectifies consumer’s inaccurate personal data without undue delay. Taking into account the purpose of the processing, the consumer has the right to supplement incomplete personal data.
The Right to erasure (“right to be forgotten”)
The consumer has the right to request that the data operator erases his/her personal data without undue delay, and the data operator is required to erase consumer’s personal data without undue delay in the following cases:
- the personal data are no longer necessary for the reason they were originally collected or processed;
- when the consumer withdraws his/her consent which has been the lawful basis for holding the data;
- when the data operator is processing consumer’s personal data for direct marketing purposes and the consumer objects;
- when the data operator has processed consumer’s personal data unlawfully;
- when personal data need to be erased in order to comply with a legal obligation of EU or Slovenian laws.
The data operator shall take reasonable steps, including technical measures, to be able to inform data processors that the consumer requests that any links to or copies of personal data be erased.
The right to restrict processing
The consumer has the right to limit the way the data operator uses consumer’s data. The right is not absolute and only applies if:
- the consumer contests the accuracy of his/her personal data and the data operator is verifying it;
- the data have been unlawfully processed and the consumer doesn’t want them erased but requests instead a restricted use of them;
- when the data operator no longer needs personal data for the purpose of processing but is required by the consumer to keep them in order to establish, exercise or defend a legal claim;
- when the consumer has raised an objection to processing of his/her data and the data operator is considering whether legitimate grounds override those of the consumer.
The right to data portability
The consumer has the right to receive personal data that he/she provided to the data operator in a structured, commonly used and machine-readable format and the right to transmit those data to another data operator. The right applies when the following conditions are met:
- processing is based on the consumer’s consent or a contract;
- processing is carried out by automated means.
The right to object to processing
The consumer has the right to object to the processing of his/her personal data at any time. The applicability of this right depends on the purposes that the data operator has for the processing and on the lawful basis for processing. The consumer has the absolute right to object to the processing of his/her data if it is for direct marketing purposes. When direct marketing is based on the consumer’s consent, the right to object to the processing may be exercised by consumer withdrawing the consent.
The procedure for the exercise of the rights
The consumer may exercise his/her rights in regards to the personal data protection by addressing his/her claim in writing to the data operator: by e-mail to info@eywineo.eu or by post to: EYWINEO eterična olja, Vinko Nedelko s.p., Rošpoh-del 157B, 2351 Kamnica, Slovenia.
If the consumer submits the claim by e-mail, the response will be provided by e-mail, as well, unless the consumer specifically demands that the response be provided by another means.
For the purposes of a reliable identification, the data operator may request that the consumer provides additional information necessary for the authentication of consumer’s identity, and may refuse to act in accordance with this chapter if it proves that the consumer cannot be reliably identified.
The data operator will respond without undue delay and no later than one month after the receipt of the claim with which the consumer is exercising his/her right to the personal data protection. The data operator may extend the response deadline by maximum two additional months on the reason of complexity and number of claims. In that event the data operator will inform the consumer within one month of the reception of consumer’s claim, giving the reasons for a delayed response.
If consumer’s claims under this chapter prove to be manifestly unfounded or excessive or repetitive the data operator may:
- charge a reasonable fee based on the administrative costs of complying with the claim,
- refuse to deal with the claim.
The right to file a complaint concerning the processing of personal data
The consumer may file a complaint regarding the processing of his/her personal data in writing to the data operator: by e-mail to info@eywineo.eu or by post to: EYWINEO eterična olja, Vinko Nedelko s.p., Rošpoh-del 157B, 2351 Kamnica, Slovenia.
The consumer may also file a complaint directly with the Information Commissioner if the consumer believes that the processing of his/her personal data violates Slovenian regulations or the EU Data Protection Directive.
Validity
The personal data protection policy is in force as of 1st of June 2020 and may be amended or supplemented at any time. The consumer is therefore asked to check for the most recent version prior to communicating his/her personal data.
